The owner of the online shop shop.fookuspookus.ee (hereinafter referred to as the Online Store) is OÜ Fookus Pookus Grip (registry code 12159527), seat Harju maakond, Rae vald, Peetri alevik, Allika tee 12, 75312.
Validity of the sales contract, goods and price information
The terms and conditions of sale apply to the purchase of goods from the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. A delivery fee is added to the price. All prices of goods sold in the Online Store are in euros.
The delivery fee depends on the location of the buyer and the method of delivery. The delivery fee is displayed to the buyer when placing an order.
Information about the goods is provided in the Online Store directly next to the goods.
To order the goods, the desired products must be added to the shopping cart. To place an order, it is necessary to fill in the required data fields and select the appropriate method of delivery. The Online Store will then display the amount of the fee which can be paid securely through the following payment methods:
- Card payment: Visa, Mastercard, American Express, Union Pay
- International payment solutions: ABN AMRO, ASN BANK, BUNQ B.V., ING BANK, KNAB, RABOBANK, REGIOBANK, REVOLUT, SNS BANK, TRIODOS BANK, VAN LANSCHOT, YOURSAFE, IDEAL
- Payment on the basis of an invoice.

Payments are mediated by Stripe, Inc. Payments are made outside the Online Shop in a secure environment – in the secure environment of the bank providing the service when paying by credit card and in the secure environment of the company providing the service when using an international payment solution. The seller does not have access to the bank and credit card details of the Customer. The contract enters into force upon receipt of the amount due to the current account of the Online Store.
The owner of the Online Store is the controller of personal data and forwards the personal data necessary for making payments to the authorised payment service provider.
If the ordered goods cannot be delivered due to them being out of stock or for any other reason, the buyer will be notified as soon as possible and will be provided with an estimated time of manufacturing the undergoing product. If the buyer chooses to refuse from the offer the money paid (including the delivery fee) will be refunded immediately, but not later than within 14 days of sending the notice.

The buyer can choose between the following delivery options: DHL Express, DHL Economy.
The costs of sending the goods are borne by the buyer and the respective price information is listed by the delivery method.
Goods ordered to Estonia generally reach the destination specified by the buyer within four working days from the entry into force of the sales contract. Delivery outside Estonia takes place within ten calendar days.
In exceptional cases, the goods may be delivered within 45 calendar days.
After receiving the order, the buyer has the right to withdraw from the contract concluded in the Online Store within 14 days.
The right of withdrawal does not apply if the buyer is a legal person.
In order to exercise the 14-day right of return, the ordered goods may not be used in any other way than is necessary to verify the nature, characteristics, and functioning of the goods in the manner permitted for testing the goods in a physical store.
If the goods have been used for purposes other than those necessary to ascertain the nature, characteristics, and functioning of the goods or have signs of use or wear, the Online Store has the right to reduce the refundable fee in accordance with the decrease in the value of the goods.
The costs of returning the goods are borne by the buyer, unless the reason for the return is due to the fact that the product to be returned does not correspond to what was ordered (e.g. wrong or defective product).
The buyer must return the goods within 14 days of submitting the application or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Upon receipt of the returned goods, the Online Store will return to the buyer immediately, but not later than 14 days after receipt of the withdrawal application, all fees received from the buyer on the basis of the contract.
The Online Store may refuse to make refunds until the goods that are the object of the contract have been returned or until the buyer has provided proof that they have returned the goods, whichever is earlier.
If the buyer has expressly chosen a delivery method other than the cheapest delivery method offered by the Online Store, the Online Store does not have to reimburse the consumer for the cost that exceeds the cost of the standard delivery method.
The Online Store has the right to withdraw from the sale transaction and reclaim the goods from the buyer if the price of the goods in the Online Store is marked significantly below the market price of the goods due to a mistake.
The Online Store is liable for non-compliance or defect of the goods sold to the buyer which already existed at the time of delivery of the goods and which becomes apparent within two years from the delivery of the goods to the buyer. During the first year from the delivery of the goods to the buyer, it is presumed that the defect already existed at the time of delivery of the goods. It is the responsibility of the Online Store to rebut the respective presumption.
The Online Store is not responsible for defects that have occurred after the delivery of the goods to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will return all fees associated with the sales contract to the buyer.
The Online Store responds to the complaint submitted by the consumer in writing or by any means which leaves a written record within 15 days.
The Online Store uses the personal data entered by the buyer only to process the order and send the goods to the buyer. The Online Store transmits personal data to transport companies in order to deliver the goods.
The Online Store will send newsletters and offers to the buyer’s email address only if the buyer has expressed a wish by entering the e-mail address on the website and has announced their wish to receive direct mail notifications.
The buyer can unsubscribe from the offers and newsletters sent to the email at any time by notifying us by email or by following the instructions in the email containing the offers.
If the buyer and the Online Store are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The terms of the procedure can be viewed and the application submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The review of the buyer’s complaint in the committee is free of charge.
The buyer can turn to the European Online Dispute Resolution platform.
